Right of Withdrawal

(i) Right of Withdrawal

The term “right of withdrawal” (Widerrufsrecht) used in Germany and in the Consumer Rights Directive corresponds to the term “right of rescission” (Rücktrittsrecht) commonly used in Austria. We therefore use the equivalent term pair “right of withdrawal (right of rescission)”. In the withdrawal instructions, only the term “right of withdrawal” is used. This is equivalent to the Austrian term “right of rescission”.

The withdrawal period—without stating reasons—is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the last item.

(ii) No Right of Withdrawal

According to § 18 FAGG, the customer has no right of withdrawal (in addition to other exceptions) for:

• Goods that are manufactured according to customer specifications or are clearly tailored to personal needs.
• Goods that can spoil quickly or whose expiration date would be quickly
  exceeded.
• Goods that are delivered sealed and are not suitable for return for reasons of health protection or hygiene, provided their seal was removed after delivery.
• Goods that, after delivery, have been inseparably mixed with other goods due to their nature.

(iii) Consequences of Withdrawal

If you withdraw from this contract, we must refund all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we received notification of your withdrawal from this contract.

For this refund, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this refund.

We may refuse the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

You must return or hand over the goods to us without undue delay and in any case no later than fourteen days from the day on which you notify us of the withdrawal from this contract. The deadline is met if you send the goods before the fourteen-day period expires.

You must bear the cost of return shipping. In the case of signs of use, damaged packaging or goods, missing parts, or unpaid return shipping costs, Schalk Mühle will charge a reasonable fee for use, including compensation for any associated reduction in the common value of the service (see (ii)).

If you withdraw from a contract for online vouchers (Schalk Mühle Genussschein), it will be blocked for further use. If the voucher is redeemed—in whole or in part—before this time, the payment to be made by Schalk Mühle will be reduced by the amount you have already redeemed, as the prior use of the voucher is not attributable to handling that is not necessary for testing the nature, characteristics, and functionality of the voucher (see (ii)).

(iv) Exercising Your Right of Withdrawal

To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear statement. You have the following options:

• You send us an informal statement by post or email.
• You use our online form Withdraw from Contract and submit your withdrawal directly electronically via our website.

If you use the online form, we will send you confirmation of receipt of your withdrawal without delay (e.g., by email). To meet the withdrawal deadline, it is sufficient that you send notification of exercising your right of withdrawal before the withdrawal period expires.
